LIABILITY WAIVER; ASSUMPTION OF RISK
ASSUMPTION OF RISK; RELEASE OF LIABILITY, WAIVER OF CLAIMS, AND INDEMNITY AGREEMENT
MUST BE COMPLETED TO ENTER THE FUSING STUDIO
ASSUMPTION OF RISK:
The Glass Bar, LLC operates a Stained Glass and Glass Fusing Studio with the use of soldering irons, kilns, and other glass-working equipment (the “Studio”). The undersigned participant, and where the participant is under age 18, the undersigned parent or guardian of the participant, for themselves and on behalf of the participant, including their heirs, next-of-kin, personal representatives, successors, and assigns:

Acknowledges that working with glass, soldering irons, kilns, and other Studio equipment involves certain inherent risks, dangers, and hazards, which can result in personal injury, property damage, and other losses; and

Freely agrees to assume and accept all such risks of personal injury, property damage, and loss associated with the Studio, including risks arising from participant conduct, the Studio’s design and operation, the conduct of The Glass Bar, LLC and its directors, officers, shareholders, trustees, beneficiaries, employees, agents, representatives, independent contractors, subcontractors, sponsors, successors and assigns, and the conduct of other participants.
RELEASE OF LIABILITY, WAIVER OF CLAIMS, AND INDEMNITY AGREEMENT:
In consideration of the use of the Studio, the undersigned participant, and where participant is under age 18, the undersigned parent or guardian, hereby agrees:

To waive any and all claims that participant, parent, guardian, heirs, or assigns may have or may in the future have against The Glass Bar, LLC and its directors, officers, shareholders, trustees, beneficiaries, employees, agents, representatives, independent contractors, subcontractors, sponsors, successors and assigns (collectively, the “Release-es”) and to release the Release-es from any and all liability for any loss, damage, expense, or injury, including death, arising from any aspect of the participant’s use of the Studio, due to any cause whatsoever, including negligence.

To hold harmless and indemnify the Release-es from any and all claims and liability arising out of or in connection with the participant’s use of the Studio, and for any damage to property of or personal injury to any third party resulting from the participant’s use of the Studio.
SURVEILLANCE CAMERAS:
Participants acknowledge that The Glass Bar, LLC maintains surveillance cameras throughout the Studio for the protection of participants, staff, equipment, materials, and property. Video and photographic recordings may be used for safety, security, or legal purposes, including protection against theft, liability claims, and enforcement of Studio policies.
STUDIO POLICIES:

Footwear: Closed-toe shoes are mandatory for entry into the Studio at all times to reduce the risk of injury.

Materials and Projects Storage: Participants may leave materials and projects in the Studio only in designated storage areas. Any materials or projects left in the Studio for more than 90 days without communication with The Glass Bar, LLC may be considered abandoned and subject to forfeiture at the sole discretion of the Studio. The Studio is not responsible for replacing or repairing projects damaged in the kiln or otherwise while stored in the Studio.
CONSENT TO MEDICAL TREATMENT:
The undersigned authorizes The Glass Bar, LLC to obtain emergency medical attention and treatment on behalf of themselves or their minor child in case of sickness, accident, or injury, at the undersigned’s sole expense. The undersigned understands that it may be necessary to transport a minor child to the nearest medical facility even if the condition may not warrant emergency care.
PERMISSION TO USE IMAGES AND OTHER MEDIA:
The undersigned grants The Glass Bar, LLC and any authorized third party the right to film, photograph, videotape, record, and/or reproduce the likeness or voice of the participant or minor child in open and public areas of the Studio. The undersigned further grants the Studio the right to use, display, and digitally enhance or alter such likeness or recordings in any media without compensation, attribution, or notice.
CHOICE OF LAW AND VENUE:
This Agreement shall be governed and interpreted solely under the laws of the Commonwealth of Massachusetts. Any litigation involving the parties shall be brought exclusively within Norfolk County, Massachusetts, and shall be subject to the jurisdiction of its courts.
I HAVE READ AND UNDERSTAND THIS AGREEMENT, AND I AM AWARE THAT BY SIGNING THIS AGREEMENT I AM WAIVING CERTAIN LEGAL RIGHTS THAT I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, AND REPRESENTATIVES MAY HAVE AGAINST THE RELEASE-ES.
